These are the rules for using Ottermates, and they are also the end user license agreement, the EULA, for the app. By using Ottermates you agree to them. We have kept them short and readable, because terms nobody can read protect nobody.

You are not buying the app itself. You get a license to use it: a personal one, which you cannot pass to anyone else, covering the Apple devices you own or control and following the usage rules in Apple's App Store Terms of Service. Apple's standard license terms apply alongside this page, and you can read them at apple.com. If you installed Ottermates from Google Play, Google's terms apply in the same way.
This agreement is between you and Fabulous Apps LLC. It is not with Apple. Apple does not run Ottermates and is not responsible for it. We are, for the app, for what is in it, and for helping you when something goes wrong, which is what hello@ottermates.app is for. If the app turns out not to work as promised, you can tell Apple and Apple may refund what you paid for it. Beyond that refund, Apple owes you nothing for this app.
If anyone claims Ottermates infringes their rights, or that it falls short of a product safety, consumer protection or privacy law, answering that claim is our job and not Apple's. By using the app you also confirm you are not in a country the United States has embargoed, and that you are not on a United States list of prohibited or restricted parties.
Apple and its subsidiaries can rely on this agreement as a third party, which means Apple may enforce it against you if it ever needs to.
You need to be at least 18 years old. Ottermates is made for adults in relationships and some question packs are written for an adult audience.
For new couples covered by our subscription access policy, Premium is required for daily questions and question packs. Access is available through an active subscription, including an eligible monthly free trial.
Existing couples who qualify for grandfathered access keep their existing free access under that policy. The app shows which access and subscription options apply to you. A subscription includes daily questions, shared history, reactions, question packs and kelp saves while access is active.
Prices are shown in your local currency in the app, and the amount you see there is the amount you pay. Prices may differ by country because stores convert and adjust them.
Eligible monthly subscriptions include a seven-day free trial. The yearly subscription has no trial. Trial eligibility is determined by Apple or Google and is shown before you confirm your purchase. After the trial, the monthly subscription automatically renews at the price shown in your local currency unless you cancel before the trial ends. If you are not eligible, the regular price applies from purchase.
One subscription covers both of you. When one partner subscribes, both partners get everything. You do not each need to pay.
Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged for renewal within 24 hours of the period ending.
You manage and cancel your subscription in your Apple or Google account settings, not in Ottermates, because that is where the payment lives. Deleting the app does not cancel a subscription.
Refunds are handled by Apple or Google under their policies, since they take the payment. If something has gone wrong, email us anyway and we will help you sort it out.
If subscription access expires and neither partner has an active subscription, trial or other qualifying access, subscription features are locked until access is restored. Cancellation by itself does not end access before the current entitlement ends. Expiration does not itself delete your answers or change your ownership of them. Grandfathered free access is preserved for couples who qualify.
What you write in Ottermates is yours. We do not claim ownership of it, we do not use it to train anything, and we do not publish it. We store and display it for the narrow purpose of running the app: showing it to your partner after you have both answered, and showing it back to you both later.
Ottermates is a private space between two people, so there is not much to police. Still: do not use it to harass or abuse someone, do not use it if you are not old enough, and do not try to break, overload or reverse engineer the service. We may suspend an account that is being used to harm someone.
You can unpair at any time. If you do, each of you keeps your own answers and your own copy of the history. Premium follows whoever paid for it.
We will keep improving Ottermates, which means features can change. If we ever need to remove something you paid for, we will tell you first and make it right.
We work hard to keep Ottermates running and your writing safe, but we cannot promise the service will never be unavailable or that it will be free of faults. The app is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to what you paid us in the twelve months before the problem.
None of this takes away rights you have under the consumer law where you live. If your local law gives you more, your local law wins.
You can stop using Ottermates at any time and delete your account from within the app. We may end your access if these terms are seriously or repeatedly broken.
If we change these terms in a way that matters, we will update the date above and tell you in the app before the change takes effect.
